Individually, authoritarians like Trump have an advantage, but collectively, law firms, universities, and the public have the advantage. Just look at Jimmy Kimmel. Individually, he was cooked, but collectively (through the loss of a ton of subscriptions), he got his job and his voice back.
As for Justice Thomas, I heard Justice Sotomayor speak at the Free Library of Philadelphia. She said that when she writes a dissent, she’s writing for many different voices. To give the person who lost the courage to know that she supported them. To other justices to get them to rethink their position. To the state and federal legislatures to encourage them to enact legislation to counter bad decisions. To the public to help them understand. By failing to ask questions, Thomas is just preaching to his own choir; he’ll be irrelevant when he’s no longer a Justice.
